3. Service Agreements
Any service work performed by Dan Diprima Heating & Air Conditioning is subject to a separate service agreement or work order that outlines the specific scope of work, pricing, and terms. By scheduling service, you agree to the terms outlined in that agreement.
4. Pricing and Payment
- Estimates: Written estimates are valid for 30 days from the date issued. Final prices may vary based on actual conditions discovered during service.
- Payment Terms: Payment is due upon completion of service unless other arrangements have been made in advance.
- Payment Methods: We accept cash, check, and major credit cards. Financing options may be available for major installations.
- Returned Payments: A fee of $50 will be charged for returned checks or failed credit card transactions.
5. Cancellations and Rescheduling
We ask that you provide at least 24 hours' notice when canceling or rescheduling a service appointment. Cancellations with less than 24 hours' notice may incur a service fee to cover technician dispatch costs.
6. Warranties and Guarantees
- Labor Warranty: We offer a 5-year labor warranty on most new installations. Specific warranty terms are outlined in your service agreement.
- Manufacturer Warranties: Equipment warranties are provided by the manufacturer and vary by product. We will provide warranty documentation upon request.
- Service Guarantee: If you are not satisfied with our workmanship, we will return to correct the issue at no additional charge within 30 days.
7. Limitation of Liability
To the maximum extent permitted by law, Dan Diprima Heating & Air Conditioning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.
8. Emergency Service Terms
Emergency repair services are available 24/7 for heating and cooling system failures that pose immediate safety risks or render the home uninhabable. Emergency service fees may apply outside of normal business hours (7 AM - 6 PM Monday through Saturday).
9. Maintenance Plans
Annual maintenance plans are annual recurring agreements that include one comprehensive system inspection and tune-up per year. Plan benefits and pricing are subject to change with 30 days' notice. You may cancel your plan at any time with no cancellation fees.
10. Website Use
Our website is provided for informational purposes only. You may not reproduce, distribute, modify, or exploit any content from this website without our express written consent. We reserve the right to modify, suspend, or discontinue any aspect of this website at any time.
11. Privacy and Data Use
Information collected through our website and services is governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in that policy.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If a resolution cannot be reached, disputes may be submitted to binding arbitration in Worcester County, Massachusetts.
